Hundreds gathered Tuesday to show support for Kamehameha Schools after a lawsuit was filed challenging its admissions policy.

Virginia-based nonprofit Students for Fair Admissions filed on Monday the 

: calling Kamehameha Schools’ admissions policy illegal race-based discrimination, the suit demands that a court issue a permanent injunction from considering applicants’ Native Hawaiian ancestry when making admissions decisions.

The suit, filed in the U.S. District Court for the District of Hawai‘i, claims that the admissions policy — which KS 

 gives preference to applicants with Native Hawaiian ancestry “to the extent permitted by law” — has prevented any non-Native Hawaiian student from attending in at least 15 years.

In response, KS assured parents on Monday that the school is “resolved to vigorously defend our admissions policy and will engage ever legal and operation resource to protect [it].”

“The facts and the law are on our side and we are confident that we will prevail,” read the KS letter.

That message was reinforced at a Tuesday rally before ‘Iolani Palace, where scores of attendees sang and chanted in support of the school.

Crystal Kauilani Rose, chair of the KS Board of Trustees, told attendees that she had helped KS fight against the “Doe Lawsuits” — two suits in which non-Hawaiian teenagers sought admission to KS but were ruled against by a U.S. District Court judge — 20 years ago and is prepared to do so again.

“We understand the law,” Rose said. “We understand the facts. And the law and the facts are on our side … we are warriors, we are fighters and we know how to do it.”

KS won the first Doe suit, filed in 2003, by arguing that it is privately funded and exists to correct educational imbalances that Native Hawaiians face compared to other ethnicities.

 in the first Doe suit that KS is in a unique situation, as the U.S. has a special trust with Native Hawaiians after Congress adopted the Apology Resolution — which acknowledged that the U.S. overthrow of the Hawaiian Kingdom was unlawful — and that KS’ policies align with Congress’ own goals of remedying the systemic disadvantages faced by Native Hawaiians following the state’s annexation.

But the latest suit argues that KS won that first Doe suit “by the narrowest of margins” and only prevented it from being appealed to the U.S. Supreme Court by paying the student $7 million.

The suit claims to represent two Hawai‘i families — identified only as Family A and Family B — who would prefer to allow their daughters, respectively in ninth and second grade, to attend KS rather than public schools. However, the suit states that they have not applied, as their children are not Native Hawaiian and believe they would not be accepted.

In its explanation of the background the case, the suit takes great pains to highlight abuse leveled at the plaintiffs and Edward Blum, founder of Students for Fair Admissions. About eight pages of the 56-page suit enumerate various comments and voicemails strewn with profanity, racial slurs and death threats directed at the plaintiffs and Blum following the announcement of the lawsuit.

The first specific legal argument in the case takes aim at the contract that parents are required to sign upon their child’s admission to KS. Given that KS’s admission’s process does favor specific people by race, the argument goes, these contracts are inherently “race-based contracting,” which is illegal.

The second argument claims that KS’ policy cannot stand as a valid affirmative action policy, given that it bars practically any non-Native Hawaiian applicant and has no stated end date. 

At the same time, the suit the need for any affirmative action policy to benefit Native Hawaiians may have passed, as educational outcomes for Native Hawaiian students have improved over the last 20 years. The suit goes on to state that public schools in the state are chronically underfunded, suggesting students of other ethnicities would benefit from a more open admissions process at KS.

The suit also argues that creating a statutory carveout so as to make an exception for KS would also be unconstitutional.

A long-running battle between conservation groups and commercial fishers is flaring up once again.

The Hawai‘i Department of Land and Natural Resources is preparing to adopt 

 administrative rules governing aquarium fishing off the western shores of Hawai‘i Island.

These new rules would permit commercial aquarium fishing of eight specific species by up to seven permittees. Those permit holders would be subject to collective annual catch limits for each of those eight whitelisted species.

Despite the severe restrictions posed by the proposed rules, they would be a boon for a moribund industry, as aquarium fishing has been entirely banned in West Hawai‘i following a 2017 ruling by the State Supreme Court — the court found that DLNR had improperly permitted aquarium fishers to take vast amounts of fish without any environmental review.

But environmental groups believe the new rules fly in the face of the Board of Land and Natural Resources’ previous rulings on the matter.

“It’s a pretty big betrayal,” Rene Umberger, executive director of environmental group For the Fishes, told Aloha State Daily.

Umberger, who was one of the plaintiffs in the Supreme Court case that halted aquarium fishing, said that the BLNR in 2023 directed the DLNR’s Division of Aquatic Resources (DAR) to develop stringent rules to regulate aquarium fishing, having decided that a total ban was not feasible or fair long-term.

At a 2023 meeting, BLNR Chair Dawn Chang told DAR that the new rules may determine an acceptable level of aquarium fishing that is “short of zero.” Umberger said that she and other environmentalists figured that “short of zero” would still be close to zero.

Instead, Umberger said, the catch limits within the new rules are unacceptably high. She claimed that, before the ban on aquarium fishing, seven permit holders could collectively bring in about 56,000 fish every year, but the new rules allow seven permittees to bring in more than 200,000.

“They’re just letting aquarium collectors back on the reef,” Umberger said.

Umberger said she and other advocates had suggested alternate rules that would still allow aquarium fishers to operate. For example, she said allowing unlimited take of non-native species could be beneficial for the ecosystem and would still allow fishers to collect attractive and photogenic specimens.

Alternatively, Umberger said she suggested a ban on taking yellow tang or other species currently available through captive breeding.

Instead, Umberger said, DAR has proposed rules that she believes cannot stand.

“I believe that the board will see that this is not what they asked for,” Umberger said. “I really don’t think the board will approve this.”

But the board on Friday is no doubt in for a long day. The 2023 hearing on the subject lasted for three days as hundreds of people testified, mostly in opposition to aquarium fishing.

A statement by For the Fishes published last week cited a poll that found that 84% of O‘ahu and Hawai‘i Island residents support permanently ending the catching of reef fish for commercial aquariums.

However, commercial fishers disagree. Commercial aquarium fisher Ron Tubbs has filed a contested case against the BLNR’s 2023 decision, although the board seems poised to deny it.

When asked to comment on the new rules, Tubbs presented ASD with a 2024 DAR 

 that found negligible differences in targeted fish populations across multiple ocean management areas before the ban on commercial aquarium fishing.

That report concluded that DAR found no clear evidence that previously proposed take limits — some of which were higher than those currently being discussed —  will result in population declines that will impact the population’s long-term viability, and that DAR can effectively manage and mitigate any potential negative impacts by commercial aquarium fishing.

The BLNR will discuss scheduling public hearings on the new rules at its Friday hearing at 9 a.m.

The City and County of Honolulu is continuing its push to develop thousands of affordable housing units across O‘ahu — now its 

Department of Housing and Land Management

 is seeking a development partner for a new affordable rental community on city-owned land in Royal Kunia.

Located at the corner of Kupuohi Street and Kupuna Loop, the project site is home to the Royal Kunia Park & Ride and the Honolulu Community Action Program's Head Start child care facility. The site includes about 120,000 square feet of space for affordable housing as well as an adjoining parcel for a future child care facility, the city said in a recent announcement.

The selected developer will be offered a 75-year ground lease and must conduct "robust" community engagement throughout the planning and design process.

Partnering with the development community to build housing on city-owned lands is one of the components of a strategic housing plan the city unveiled 

DHLM Director-designate Kevin Auger noted in the announcement that city has identified 10 city-owned properties that could potentially deliver 2,500 housing units. This is the eighth city-owned property activated so far this year.

"Each property tells a different chapter in Oʻahu’s housing story, and Royal Kunia is about strengthening a family-oriented community with new opportunities for residents leveraging public lands,” he said in the announcement.

Auger told Aloha State Daily via email that the Royal Kunia project is expected to be affordable, serving households at 60% of the area median income or below, or workforce housing, serving households making between 60% and 120% AMI, or a combination of both, depending on the type of financing that can be secured. These limits vary and are based on household size. You can find the

"Having the early child education component is what makes this site highly attractive for workforce housing."

"The administration is executing on the strategic plan that we rolled out in January this year," Auger told ASD. "Working with the Governor’s Office to amend the governor’s emergency proclamation for housing to allow the city to issue requests for qualifications in seeking development partners has been [a] game changer, allowing us to accelerate the overall procurement timeline. This was a novel approach that had not been done before in the city.

"The response from the development community to these RFQs has been overwhelmingly positive," he continued. "We are now negotiating development contracts with several highly qualified developers which instantly expands the City’s capacity to do more, faster.  Our goal is to establish a development pipeline of [approximately] 2,500 affordable housing units by year-end, which is unprecedented."

Auger says that the next step in the housing effort will be to 

develop alternative forms for financing for these projects to accelerate delivery, which will be key to the city's overall success.

"Having a pipeline this substantial also allows us to work continue to build-out our platform and train and develop the next generation of city housing specialists. We are all working hard to make up for nearly 30 years of neglect, but we believe we are off to a really good start."

The most bizarre section in Hawai‘i’s 

 is the one that relates to the state’s regulation of population growth. It is a testament to a bygone era informed by misguided local anxieties. 

Runaway population growth across the Hawaiian Islands once occupied the Hawai'i zeitgeist. While much of this mindset persists in the halls of society, it contrasts with Hawai‘i’s contemporary demographic woes. 

Between April 1960 and April 1970, Hawai‘i added 115,510 residents to its population, totalling 748,182 residents across the islands. It was a meteoric rise that stressed the Hawai‘i’s poor infrastructure, corrupt land management practices, and limited housing across the islands. 

Hawai‘i was a young, growing society. The median age of a resident was 25. Much of the State’s dynamism and vigour, in turn, were informed by a mix of talent both local and non-local.

During this time, national commentators were fretting about the global population’s growth. Paul and Anne Ehrlich had co-authored 

in 1968. Internationally, the Club of Rome furnished the

report, which only further argued against overconsumption. Political views wrapped in scientific dogma started-off a new movement whose cultural salience was confirmed by the 1973 film 

While societies were wasteful and inefficient, these reports didn’t necessarily call for more efficiency. Instead, they called for fewer people. 

While the times have changed, our Constitution’s outdated language shows how we are still stuck in the ’70s. Through national debates over population control, Hawai‘i became a tragic guinea pig that used environmentalism to justify population control, opening the floodgates for arguments against urban development, immigration, and economic growth. 

These conversations continue to plague Hawai‘i’s zeitgeist, most notably when it comes to unnecessary conflict between economic growth and environmental stewardship.

In 1970, the Hawai‘i State Legislature passed Senate Resolution 305, establishing the State’s Temporary Commission on Population Stabilization. A 1972 report issued by the Commission suggested an inverse relationship between environmental stewardship and population growth. 

“It remains to be seen whether or not we will achieve a balance with the limits of the Hawaiian environment in this present period of growth in Hawaiian history,” the 

 warned, “but it should be recognized that with respect to maintaining the quality of the environment, population and prosperity are ‘trade-offs.’ If we expect to maintain a fixed level of pollution and impact on the environment by people in Hawaii, then any increase in one will require a corresponding decrease in the other.”

In the following year, the State Senate once again adopted a resolution calling for the establishment of an optimum state population. “The question of population equilibria among the Islands is a difficult one to answer quantitatively,” a 

 from the Department of Planning and Economic Development warned.

“One must consider the impact on the environment, what ‘quality of life’ should be used as a measure, means of developing a viable economy within a stable population, and the size of population on each Island which will bring about a desirable balance with the social and natural environment of Hawai‘i.”

Nationally, the Commission on Population and the American Future had been established by federal law in March 1970. A final 

 issued by the Commission was submitted to the U.S. Congress in March 1972, with proposals ranging from increased abortion access to voluntary sterilization to stricter immigration controls. Out of political embarrassment for its recommendations, the Nixon Administration largely distanced itself from the Commission.

However, the rhetoric which argued for limits on immigration had devastating consequences. In the present-day, arguments blaming immigrants for environmental degradation have had devastating 

Back in Hawai‘i, the reports stacked on one another. In 1972, Earl R. Babbie of the civic organization 

, a major argument for a cap on Hawai‘i’s population at one million (Hawai‘i’s population reached this threshold in the mid-’80s). 

These reports built a case for a more permanent state agency tasked with controlling the state’s population growth. As a result, the Commission on Population Stabilization and the Hawaiian Future was 

A primary architect of the measure, Nadao Yoshinga, was not solely worried about the influx of outsiders. Natural population growth among existing residents was another worry. Yoshinaga, an influential member of the State Senate, would 

 in the name of limited Hawai‘i’s population growth over the coming years. Limiting population by whatever means necessary (in the confines of the law) was the objective.

At around this time, Robert C. Schmitt, the State Statistician of Hawai‘i, 

 of the emerging field of population policy. Proponents of population control, at least in the early Statehood era, had started to organize in the late ’60s through such organizations as the University of Hawai‘i-sponsored Zero Population Growth-Honoulu, Citizens for Hawai‘i, Life of the Land, the Sierra Club, and Save our Surf. 

These groups advocated for policies to halt population migration, economic development, and other factors like densified communities in the name of environmentalism. Perhaps tragically, this misguided approach to Hawai‘i’s prevailing problems created a manichean world of values in conflict with one another.

Arguments for population control in the name of environmental stewardship had a real impact on policy in the late ’70s. Most notably, this came to a head in 1977.

During his annual State of the State address, Governor George Ariyoshi directly addressed population control, arguing for immigration controls and density regulation in the name of the ‘aloha spirit.’

“The problem of excessive population seems to be central to nearly every problem in the State.” he started. “Too many people means too few jobs and too much competition for them. Too many people means too little land for agriculture, parks, and scenic vistas. Too many people means too much crime and too much erosion of possibly our single most important commodity: the Aloha Spirit. Too many people means too much pressure on all our governmental and private institutions.” 

Ariyoshi wanted fewer people in Hawai‘i, plain and simple. To reinforce his views, the State Legislature even sponsored a 

 on population and the Hawaiian future in March 1977. 

One piece of legislation would have discriminated against recent arrivals to Hawai‘i through residency requirements for state jobs. A Federal Judge based in Honolulu, the part-Hawaiian Sam P. King, condemned the State of Hawai‘i’s flirtation with a flagrantly “anti-migratory” statute.

These attempts provide a marked contrast with the present day. In January 2025, the Department of Human Services 

 that the State suffers from a vacancy rate of 24% of all civil services positions (equivalent to more than 4,000 jobs). 

Nevertheless, Hawai‘i still inserted a section into its Constitution at the 1978 Constitutional Convention that called for population planning. To date, it is the only Constitution in the United States with such explicit language.

Instead of promoting smarter urban planning methods that conserved space while reducing sprawl or incentivizing farmers to bring more fallow agricultural land into cultivation, it was more convenient to blame the outside migrants for Hawai‘i’s development problems.

Instead of fostering solutions which invite greater societal innovation, it is more convenient to fall for an ideology wrapped in the veneer of science. 

Since 1970, Hawai‘i’s population fortunes have reversed.

Global population growth is not exponential, nor could it sustain the growth rates witnessed after the Second World War. In fact, our planet’s 

 will likely begin declining before 2100. 

The paranoia of the ’70s became irrelevant over the following decade. By 1983, the Commission on Population and the Hawaiian Future had been abolished.

For a majority of Hawai‘i’s residents in 2025, the ’70s are a foreign, unknown domain. Since Hawai‘i’s 

 was 41 as of 2024, it’s safe to conclude more than half of Hawai‘i’s population was born after 1980.

Today, Hawai‘i is missing people. It is one of the fastest aging states in the United States. The population is contracting, with more than half of all Native Hawaiians on the planet living outside of the archipelago.

Culturally, it is still easy to blame the outsider for our own problems. Instead of acknowledging our own complicitly in failing to plan for the future, it is far easier to find that the outsider is only exacerbating the problems we are not addressing. Policies which now arrest growth not only injure potential migrants. They also hurt residents.

The debates over population control in the ’70s were about a fear of change and a society’s failure to properly navigate the pressures wrought by new forces.

Contemporary conflicts over growth still magnify this attitude. Not unironically, stewarding Hawai‘i’s environment means Hawai‘i’s environment needs to also steward Hawai‘i’s people.

“It should be remembered,” Governor John Burns said in 

, “that the key ingredient in any environment is man himself: he is part and parcel of and the key to the value of our total system of symbiotic relationships on this earth. Being a part of the environment demands that we consider human economics together with biological ecology.” 

“If man is hungry, ill-housed, undereducated or poorly treated in his society,” he wondered, “what service is it to him that his environment remains in its pristine, natural state?”

A society without one cannot have the other. We need to think about growth, not stabilization. We need to think about people.

In our own time, we need a Constitution whose thinking is not tethered to the past. While the language in outdated documents like our Constitution locks our zeitgeist in another time, we need to get over our history. We need a better zeitgeist.

A legal debate over a Kaua‘i lawyer’s 2018 “sleazy” remarks finally ended at the state Supreme Court Monday.

Seven years ago, Mark Zenger, an attorney since 1983, was representing a husband in a Kaua‘i divorce case that had turned acrimonious, particularly regarding the future of the former couple’s home.

Amid a legal back-and-forth between Zenger and his opposite number, attorney Stacey Joroff, Zenger filed a heated memorandum, describing the wife’s legal tactics as “sneaky, sleazy things [done] as part and parcel of an evil and intentional plan,” and a “hissy fit.” In a subsequent hearing, Zenger also called Joroff’s and her client’s actions “slimy” and used profanities such as “horseshit” and “bullshit.”

These remarks became the basis of a disciplinary investigation that lasted for years. After Joroff filed a complaint with the state Office of Disciplinary Counsel, the matter would go to multiple disciplinary hearings — one of which lasted six days — in 2020 and 2021, both of which found no fault in Zenger’s conduct.

Despite this, in 2023, the ODC board rejected the findings of the hearings, leading Zenger to appeal the matter to the Supreme Court.

“It’s fairly rare for these things to go to the Supreme Court,” Roy Kong, chief disciplinary counsel at ODC, told Aloha State Daily. “It’s also rare for them to come before the ODC board at all.”

Kong said public disciplinary hearings are held when an ODC investigation has determined that an attorney’s conduct warrants some sort of public penalty, which he said could range from a public admonition to suspension to disbarment. He estimated that less than 20% of all disciplinary cases go to public hearings, while even fewer go to multiple hearings and still fewer go to the Supreme Court.

In Zenger’s case, the ODC had requested he be publicly reprimanded for his conduct, which Kong said entails a public notice that an attorney has been found to violate a specific provision of the Hawai‘i Rules of Professional Conduct (HRPC).

At question was whether Zenger’s word choices — “sleazy,” “sneaky,” “evil”, “hissy fit” — violated HRPC civility rules, which Zenger denied. During the hearings, Zenger said he had “at worst, engaged in rhetorical hyperbole, which is … fully protected by the First Amendment.”

Ultimately, on Monday, the Supreme Court found Zenger had violated no rules, putting an end to the matter after seven years.

 in the opinion of the court that, under the circumstances of the divorce case, Zenger’s language was understandable: the wife had made false statements to the court about the husband’s intentions, and served Zenger by mail for a hearing scheduled a week later, giving him little time to respond.

As such, Eddins wrote that Zenger’s word choice, “though ill-mannered, … expressed Zenger’s reasonable complaints.”

Other complaints by Joroff that Zenger had “loomed over her” during a court hearing were determined to have not happened.
